Analyzing the Impact of the SEC Conflict Minerals Guidance Documents

On May 30, 2013, the United States Security and Exchange Commission (SEC) released the Dodd-Frank Wall Street and Consumer Protection Act Frequently Asked Conflict Minerals database. The succinct responses to these FAQs are generating a significant amount of interest as they clarify the scope of the rules and the associated exemptions to the law. Concurrently, the law awaited ruling on National Association of Manufacturers, Chamber of Commerce of the United States of America, Business Roundtable v. Securities and Exchange Commission, challenging the constitutionality of the conflict minerals legislation is anticipated in the near future. The recent court case filed by American Petroleum Institute, the Independent Petroleum Association of America, The National Foreign Trade Council against the SEC has cast considerable doubt on the viability of the challenge as the District Court for the District of Columbia dismissed the challenge citing a lack of jurisdiction to hear the case.

As we have crossed into June, we now have less than one year before the first conflict minerals reports are due. Consequently, the need to progress to the next stage of implementing and vetting supply chains for conflict minerals compliance has grown more dire and pressing.
